Terms of service
Terms of Service
Overview
Welcome to The 19th Fellowship. The terms “we,” “us,” and “our” refer to The 19th Fellowship.
The 19th Fellowship operates this website and store, including all related information, content, features, tools, products, and services (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide these Services to you.
These Terms of Service, together with any policies referenced below, explain your rights and responsibilities when using our Services.
Please read these Terms carefully. They contain important information concerning your legal rights, warranty disclaimers, and limitations of liability.
By visiting, interacting with, or using our Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you must not access or use the Services.
Section 1 — Access and Accounts
By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. You also represent that you have provided consent for any minor dependents to use the Services on devices you own or manage.
You may be asked to provide information such as your email address, billing information, payment details, and shipping address. You represent that all information you provide is accurate, current, and complete and that you have the right to provide it.
You are responsible for protecting your account credentials and for all activity conducted through your account. You may not sell, transfer, assign, or license your account to another person.
Section 2 — Our Products
We make reasonable efforts to display our products accurately. However, product colors and appearance may vary depending on your device, screen, and display settings.
We do not guarantee that a product’s appearance or quality will exactly match how it appears on your screen or meet every personal expectation.
Product descriptions, availability, and specifications may change without notice. We reserve the right to discontinue products or limit quantities offered to any person, geographic region, or jurisdiction.
Section 3 — Orders
Submitting an order constitutes an offer to purchase. The 19th Fellowship may accept or decline an order at its discretion. An order is not accepted until payment has been processed and we have confirmed acceptance.
Please review your order carefully before submitting it. Because many products are made after an order is placed, we may be unable to change or cancel an order after it enters production.
If we decline, modify, or cancel an order, we will attempt to notify you using the email address, billing address, or telephone number provided with the order.
Returns, replacements, and refunds are governed by our Refund and Return Policy.
You represent that purchases are intended for personal or household use and not for unauthorized commercial resale or export.
Section 4 — Pricing and Billing
Prices, discounts, and promotions may change without notice. The price charged will be the price shown when the order is placed and confirmed in your order confirmation.
Unless expressly stated otherwise, displayed prices do not include shipping, handling, taxes, customs duties, or import fees.
Promotional offers may have separate conditions. If promotional terms conflict with these Terms, the promotional terms will govern that offer.
You agree to provide accurate and current purchase, payment, and account information. You also agree to promptly update information needed to complete transactions or contact you regarding an order.
You represent that:
-
The payment information you provide is accurate and complete.
-
You are authorized to use the selected payment method.
-
Charges will be honored by the payment provider.
-
You will pay all applicable product, shipping, handling, and tax charges.
Section 5 — Production, Shipping, and Delivery
Many of our products are made after an order is placed and require both production and shipping time.
Delivery estimates are not guaranteed unless expressly stated otherwise. Delays may occur because of fulfillment volume, carriers, customs processing, weather, holidays, or circumstances outside our reasonable control.
Products fulfilled by different partners may ship separately and arrive in multiple packages.
Current shipping information is available in our Shipping Policy. Available delivery estimates and applicable charges are also displayed at checkout.
Risk of loss may transfer to you after an order is provided to the shipping carrier, subject to applicable law.
Section 6 — Intellectual Property
The Services—including trademarks, logos, branding, text, graphics, images, product reviews, videos, audio, and website design—are owned by The 19th Fellowship, its affiliates, or its licensors and are protected by applicable intellectual-property laws.
You may use the Services only for lawful, personal, and noncommercial purposes. Without our prior written permission, you may not reproduce, distribute, modify, publicly display, republish, download, store, or transmit materials from the Services except as permitted by law.
Nothing in these Terms grants you a license or ownership interest in any trademark, copyright, patent, or other intellectual property belonging to The 19th Fellowship, Shopify, or another party.
The 19th Fellowship’s names, logos, product names, designs, and slogans may not be used without prior written permission. Shopify’s names, logos, products, and trademarks belong to Shopify. Other names and trademarks belong to their respective owners.
Section 7 — Optional Third-Party Tools
We may provide access to tools or services operated by third parties. We do not necessarily monitor or control these tools.
Third-party tools are provided on an “as is” and “as available” basis without warranties, representations, or endorsements. Your use of these tools is at your own risk and subject to the third party’s applicable terms.
New tools, features, or resources that we introduce may also form part of the Services and be governed by these Terms.
Section 8 — Third-Party Links
The Services may contain links to websites, materials, or platforms operated by third parties.
We are not responsible for reviewing or guaranteeing the accuracy, security, availability, or content of third-party services. Accessing third-party services is at your own risk.
We are not liable for harm or damages resulting from your use or purchase of third-party products, services, resources, or content. Please review the third party’s policies before completing a transaction.
Questions or complaints regarding third-party products or services should be directed to the appropriate third party.
Section 9 — Relationship With Shopify
The 19th Fellowship is powered by Shopify, which provides technology that enables us to offer the Services.
Purchases made through our store are transactions directly between you and The 19th Fellowship. Shopify is not responsible for products sold by The 19th Fellowship or for injuries, damages, losses, or disputes arising from those purchases.
To the extent permitted by law, you release Shopify and its affiliates from claims and liabilities arising from transactions between you and The 19th Fellowship.
Section 10 — Privacy
Personal information collected through the Services is governed by our Privacy Policy. Certain information may also be governed by Shopify’s Consumer Privacy Policy.
Because Shopify hosts the Services, Shopify may collect and process information concerning your access to and use of the Services. Information submitted through our store may be shared with Shopify and service providers, including providers located outside your country, when necessary to operate and improve the Services.
Please review our Privacy Policy for additional details.
Section 11 — Feedback
If you submit ideas, suggestions, reviews, proposals, plans, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display that Feedback for lawful purposes, including operating and promoting the Services.
You represent that:
-
You own or possess the rights required to submit the Feedback.
-
You have disclosed any compensation or incentives connected to it.
-
The Feedback complies with these Terms and applicable law.
We are not obligated to keep Feedback confidential, compensate you for it, or respond to it.
We may monitor, edit, or remove Feedback that we reasonably believe is unlawful, abusive, misleading, obscene, defamatory, threatening, or otherwise violates these Terms or another party’s rights.
You may not submit Feedback containing unlawful material, malicious software, or content that infringes another party’s intellectual-property, privacy, or personal rights. You may not impersonate another person or misrepresent the source of your Feedback.
Section 12 — Errors and Inaccuracies
The Services may occasionally contain typographical errors, inaccuracies, or omissions involving product descriptions, prices, promotions, shipping charges, delivery estimates, or availability.
We reserve the right to correct errors, update information, or cancel an order if information is inaccurate, including after an order has been submitted, subject to applicable law.
Section 13 — Prohibited Uses
You may use the Services only for lawful purposes.
You may not use the Services to:
-
Violate any applicable law or regulation.
-
Infringe our rights or another party’s rights.
-
Harass, threaten, abuse, defame, or harm another person.
-
Transmit false, deceptive, or misleading information.
-
Distribute spam, unauthorized advertising, or malicious software.
-
Impersonate another person or organization.
-
Collect or track personal information unlawfully.
-
Interfere with the operation or security of the Services.
-
Bypass access controls, security protections, or authorization requirements.
-
Reproduce, copy, resell, or exploit the Services without authorization.
-
Use automated scraping, data-extraction, or similar tools without permission.
We may suspend or terminate access to the Services when we reasonably believe these Terms have been violated.
Section 14 — Automated Agents
This section applies when software or a service takes autonomous or semi-autonomous actions while accessing or interacting with the Services on a person’s behalf (an “Agent”).
An Agent must identify itself accurately and comply with applicable access requirements. It must not conceal its automated nature, impersonate human activity, circumvent CAPTCHAs, or bypass measures intended to control automated access.
We may limit or block an Agent’s access to the Services at our discretion and as permitted by law.
Section 15 — Termination
We may suspend or terminate your access to all or part of the Services when permitted by law, including when these Terms are violated.
You remain responsible for amounts owed through the termination date.
Provisions that should reasonably continue after termination—including intellectual property, feedback, disclaimers, liability limitations, indemnification, severability, governing law, and privacy provisions—will survive termination.
Section 16 — Disclaimer of Warranties
Information available through the Services is provided for general informational purposes. We do not guarantee that it is complete, accurate, or suitable for every purpose.
Except where prohibited by law, the Services and products are provided on an “as is” and “as available” basis without express or implied warranties, including warranties of merchantability, satisfactory quality, fitness for a particular purpose, durability, title, or non-infringement.
We do not guarantee that the Services will always be uninterrupted, timely, secure, or error-free.
Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.
Section 17 — Limitation of Liability
To the fullest extent permitted by law, The 19th Fellowship and its affiliates, partners, officers, employees, contractors, service providers, licensors, and agents will not be liable for indirect, incidental, punitive, special, or consequential damages arising from your use of the Services or products.
This includes, without limitation, lost profits, lost revenue, lost savings, loss of data, and replacement costs, even if we were advised that such damages were possible.
Some jurisdictions do not permit certain liability limitations, so portions of this section may not apply to you.
Section 18 — Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless The 19th Fellowship, Shopify, and their respective affiliates, partners, officers, employees, contractors, licensors, service providers, and agents from third-party claims, losses, liabilities, and reasonable legal expenses arising from:
-
Your violation of these Terms.
-
Your violation of applicable law.
-
Your violation of another party’s rights.
-
Your misuse of the Services.
We will provide reasonable notice of an indemnifiable claim. You agree to cooperate with the defense of such a claim.
Section 19 — Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed from these Terms.
The remaining provisions will remain valid and enforceable.
Section 20 — Waiver and Entire Agreement
Our failure to enforce a provision of these Terms does not constitute a waiver of that provision.
These Terms and any policies incorporated by reference constitute the complete agreement between you and The 19th Fellowship regarding the Services and supersede prior agreements or communications concerning the Services.
Section 21 — Assignment
You may not transfer or assign your rights or obligations under these Terms without our prior written consent.
We may transfer or assign our rights and obligations as permitted by law.
Section 22 — Governing Law
These Terms are governed by the applicable laws and courts of the jurisdiction where The 19th Fellowship is headquartered, without regard to conflict-of-law principles.
Section 23 — Headings
Section headings are included for convenience and do not limit or otherwise affect the meaning of these Terms.
Section 24 — Changes to These Terms
We may update these Terms when necessary to reflect changes to our practices, Services, or legal obligations.
The latest version will be posted on this page. Material changes will take effect as described in any notice we provide or as otherwise permitted by law.
Your continued use of the Services after revised Terms take effect constitutes acceptance of those changes.
